For the purpose of cooperation with your company and individuals acting on its behalf, or direct cooperation with you as a non-entrepreneurial natural person, the company (hereinafter referred to as the "Controller") processes personal data of physical persons. The Controller processes personal data by the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons about the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the "Regulation") and by the provisions of Act No. 18/2018 Coll. on the protection of personal data and on amending and supplementing specific laws (hereinafter referred to as the "Act").

In order to fulfil legal obligations, the Operator provides you with the following information:

• Legal basis: Fulfillment of the contract or implementation of measures taken before the conclusion of the contract carried out at your request, including the delivery of goods via the e-shop.

3. Purpose: performance of the contractual obligation, including related business and financial communication.

• Legal basis: Protection of the rights and legitimate interests of the Operator.

4. Purpose: a collection of overdue payments for delivered goods, services or other claims of the Operator.

• Legal basis: Protection of the rights and legitimate interests of the Operator.

5. Purpose: ensuring the operability and security of our website for users and keeping statistics; concerns cases when you visit our website: https://www.lernitoys.eu/

• Legal basis: Consent of the data subject for sending newsletters. You will give us your consent voluntarily by entering your email address to receive newsletters and offers from our company.

6. Purpose: sending newsletters, promoting the Operator, its activities and services.

1. Processed personal data – based on the above, we process the following personal data:
   1. Your identification and contact details – name, email, phone number, permanent address,
   2. Data on the services you are interested in or provide,
   3. Data from our mutual communication (whether conducted in person, in writing, by phone, or otherwise),
   4. Payment details (such as the amount paid or owed, account number, etc.) if there has been a payment for services,
   5. In case of visiting our website – IP address, weblogs, cookies,
   6. In the case of operating a newsletter – name, email, and phone number.
2. Recipients or categories of recipients of personal data – We provide your data to the following categories of recipients only in justified cases and to the extent necessary:
   1. Our contractual partners with whom we cooperate in the implementation of the contractual relationship with you, such as information technology suppliers, outsourcing service providers, web hosting service providers, goods delivery companies, postal companies (e.g. DHL Express (Slovakia), spol. s r.o.) and Slovak Post, a.s.;
   2. In the case of contractual partners, providing data if required by law or to protect our legitimate interests (e.g. courts, Slovak Police, etc.).
3. Transfer of personal data to a third country or international organisation – We do not carry out such transfers.
4. The retention period for personal data – It depends on the purpose of processing. In the case of data related to contractual cooperation, it is a maximum of 5 years from the termination of collaboration unless there is a legal or administrative proceeding in which evidence containing your data is required. In the case of using a contact form on the website, it is a maximum of 1 year from submitting the inquiry. When processing data for newsletter subscriptions, we retain the data only for the duration of your consent.
5. Existence of rights exercised against the operator – as a data subject, you have rights that you can exercise at your discretion against us as the Controller. These rights include:
   • Right of access – you may request access to the personal data we process about you from the Controller. The Controller will also provide a copy of the processed personal data.
   • Right to rectification – you may request the Controller to rectify inaccurate or incomplete personal data we process about you.
   • Right to erasure – you may request the Controller to erase your data if one of the following situations occurs:
     1. The personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
     2. You have withdrawn your consent on which the processing of your data is based, and there is no other legal ground for their processing;
     3. You have objected to being the subject of a decision based solely on the automated processing of your data, and there are no overriding legitimate grounds for such processing, or you have objected to the processing of your data for direct marketing purposes;
     4. Your personal data have been processed unlawfully;
     5. Your personal data must be erased to comply with a legal obligation under EU or Member State law applicable to the data controller;
     6. Your personal data about the offer of information society services have been collected.
   • Right to restriction of processing – you can request the Controller to restrict the processing of your data if any of the following situations occur:
     1. You have contested the accuracy of your data for a period enabling the Controller to verify the accuracy of the personal data;
     2. The processing of your personal data is unlawful, but you oppose the erasure of the data and instead request the restriction of their use;
     3. The Controller no longer needs the personal data for the purposes of the processing, but you require them for the establishment, exercise, or defence of legal claims;
     4. You have objected to processing pursuant to Article 21(1) of the Regulation pending the verification of whether the Controller's legitimate grounds override your grounds.
   • Right to data portability – in cases provided for by the Regulation, you have the right to receive the personal data concerning you, which you have provided to the Controller, in a structured, commonly used, and machine-readable format. You have the right to transmit those data to another controller without hindrance, where technically feasible and without adversely affecting the rights and freedoms of others.
   • Right to withdraw consent – if the processing of your personal data is based on consent, you have the right to withdraw your consent to the processing of personal data for the purpose for which you have given consent at any time.
   • Right to object – you have the right to object at any time to the Controller's processing of your personal data for direct marketing purposes carried out on the basis of the Controller's legitimate interest.
   • Right to lodge a complaint – you have the right to lodge a complaint with the supervisory authority, the Office for Personal Data Protection of the Slovak Republic.
6. Obligation or the option to provide personal data – For sending newsletters and advertisements, you can give your consent. You are not obliged to provide us with such consent. If you decide to cooperate with us, communicate with us, or visit our website, then it is necessary for you to provide us with personal data to the necessary extent. Otherwise, it will not be possible to communicate with you, provide you with services, or allow you to browse the website thoroughly. This does not apply to the processing of cookie files, which you can change in your browser settings so that we do not process this data about you.
7. Existence of automated decision-making, including profiling – We do not carry out automated decision-making or profiling when processing personal data for the abovementioned purposes.
